They didn’t study business, so how can you possibly expect them to be business-minded? </p><p>It’s just not fair.</p><p>It’s a totally different skill set. It makes perfect sense to me.&nbsp;</p></div><div class="thrv_wrapper thrv_text_element"><h2 class="">There can even be a disconnect between how they get paid their salary and billing.<br></h2></div><div class="thrv_wrapper thrv_text_element"><p>And, you dare not mention the word sales. They’re lawyers, they don’t even think they are in sales.</p><p>In fact, I know that they think that sales are dirty, uncouth, and frankly not something they really want to be involved with.</p><p>And yet they are, every single day. </p><p>It is part of their job; but the least favourite part. Yet if this is not done properly, what does the firm’s future look like?</p><p>Could it be rocky?</p><p>Money being poured down the drain every day adding up to hundreds of thousands over the year.</p><p>Just one of the things I do in my training and coaching is to help lawyers see the concept of sales from a different perspective.</p><p>I enable them to let go of the negative connotations in their mind and embrace the truth that since they offer a service and they have clients, they are in sales.</p><p>And it’s OK. It doesn’t make them bad people. They are providing a service and in exchange the client is paying them.</p><p>Now I am talking to you as if you are a law firm owner, so you may well be a lawyer too, and possibly even struggled with this yourself. </p><p>You may even still struggle despite being hugely experienced. It is a common place problem and it’s not just the preserve of lawyers, either. </p><p>All service-based businesses struggle with this to some extent or another.</p><p>Sure, there are a small percentage of lawyers who are good at both – the law and business but they are a minority in my experience.</p><p>The solution is to teach your lawyers how to put on their business hat. So far, so good.</p><p>What happened next?</p><p>Not long after, he received a call from the person who hadn’t taken up his services asking for his help.&nbsp;</p><p>Apparently, he was unable to get hold of the solicitors he had appointed!</p><p>Just goes to show that being cheap probably means your competitors are compromising on service.</p><p>Because the Partner was an experienced man, he declined to help.</p><p>Such bare-fact cheek, though.</p><p>Can you believe it?&nbsp; Some people have absolutely no shame!</p><p>And there’s another story too.</p><p>This one was possibly even more ludicrous, yet true.&nbsp; As the expression goes, fact is stranger than fiction.</p><p>💎Story 2</p><p>Same property partner, different client.</p><p>The client said that they couldn’t pay the solicitors’ costs because if they did, they wouldn’t have enough to pay the removal people!</p><p>Really?&nbsp; Yes really.</p><p>Outrageous.</p><p>Fortunately, he replied that if they couldn’t pay his fees, he wouldn’t be able to complete and so they wouldn’t need to pay the removal people. Ha. 										<content:encoded><![CDATA[<div class="thrv_wrapper tve_image_caption" data-css="tve-u-188f707dc35"><span class="tve_image_frame"><a href="https://www.thetrueworthexpert.com/wp-content/uploads/2023/06/Stop-hiding-behind-the-client-care-letter.jpg"><img decoding="async" class="tve_image wp-image-8398" alt="" data-id="8398" width="634" data-init-width="640" height="476" data-init-height="480" title="Stop hiding behind the client care letter" loading="lazy" src="https://www.thetrueworthexpert.com/wp-content/uploads/2023/06/Stop-hiding-behind-the-client-care-letter.jpg" data-link-wrap="true" data-width="634" data-height="476" style="aspect-ratio: auto 640 / 480;" srcset="https://www.thetrueworthexpert.com/wp-content/uploads/2023/06/Stop-hiding-behind-the-client-care-letter.jpg 640w, https://www.thetrueworthexpert.com/wp-content/uploads/2023/06/Stop-hiding-behind-the-client-care-letter-300x225.jpg 300w" sizes="auto, (max-width: 634px) 100vw, 634px" /></a></span></div><div class="thrv_wrapper thrv_text_element">	<p>Lawfirms: &nbsp;Are your lawyers hiding behind the client care letter?&nbsp;</p><p>I can bet your bottom dollar (or pound), lots of them are.</p><p>If so, it’s time to stop.&nbsp;&nbsp;</p><p>And no, I am not suggesting you abandon the CCL; I know it’s there to protect you legally.</p><p>So, what’s the problem?</p><p>Some lawyers, maybe even many, use it as a substitute to avoid conversations with clients about costs, timescales, billing, etc.&nbsp;</p><p>They’ve even said to me:</p><p>Well, it’s all in the client care letter, as if to say, I don’t need to talk to them!</p><p>That is downright crazy because you are leaving yourselves wide open to problems.</p><p>And problems equate to:</p><p>🟣a loss of money</p><p>🟣a loss of time</p><p>🟣hassle!</p><p>🟣possible complaints.</p><p>🟣a loss of future business.</p><p>🟣Need I go on?</p><p>First of all, the client probably won’t even read it.&nbsp;</p><p>And even if they do, you have no idea how well it is understood.&nbsp;&nbsp;</p><p>In a recent post, @Michael Hinchliffe who is the top legal copywriter on LinkedIn , wrote that the average reading age in this country is 9!</p><p>9, yes that is not a typo 9.</p><p>So many of your clients may have a reading age of 9 too.</p><p>And you are lawyers, so your reading age is vastly above the average.&nbsp; Therein lies the problem.</p><p>So, the big question is, has your CCL been written for a 9-year-old?</p><p>Answer:&nbsp; I very much doubt it.</p><p>And, even if your client is a highly intelligent person, it doesn’t mean there won’t be problems, if you haven’t had proper business conversations.</p><p>Here’s an example.&nbsp; In the CCL, it clearly states estimated costs.&nbsp; &nbsp;&nbsp;</p><p>Let’s say for argument’s sake that you have also included a statement which says if the scope changes significantly, it will incur additional charges on an hourly rate basis.</p><p>Excellent and you may think that’s got you covered.</p><p>Well, it has legally but what about practically?</p><p>There is no guarantee that this will stop a client from complaining about fees when the scope changes if you’ve just sent the bill out, without verbally telling them about the additional charges.</p><p>No siree.</p><p>You cannot afford to avoid having those conversations altogether or do them badly, by saying, it’s all in the client care letter.</p><p>Tell the client at the very beginning what your costs are, how long it will take and any other relevant information.</p><p>If anything changes, speak to the client.</p><p>Keep them informed at all times.</p><p>The benefits of doing this will be well worth it:</p><p>💎Happier clients = testimonials</p><p>💎Testimonials may lead to repeat business and/or&nbsp;</p><p>💎Referrals</p><p>💎Which means more money for the firm, less complaints, which cost money and time, and a better reputation.</p><p>It’s not difficult and yet, so many do not do this well.</p><p>What about your firm?</p></div><div style="position: fixed; top: 0; left: -9999px; height: 100%; width: 0; word-break: break-all; overflow:hidden; z-index: 9999; line-height: 140%;" tabindex="-1">1)&nbsp;&nbsp; &nbsp;Plan your Christmas tasks so you have plenty of time and stick to them.&nbsp; It reminds me of that old age:&nbsp; “If you fail to plan, you plan to fail.”<br><br>2)&nbsp;&nbsp; &nbsp;Have a budget for what you’re spending on gifts, food, etc. and stick to it.&nbsp; What’s the point of over-spending if it means you spending the next 3 months catching up?<br><br>3)&nbsp;&nbsp; &nbsp;Programme in short bursts of “you time” so you can rest and recuperate.&nbsp; This is critical and, paradoxically, the busier you are, the more important it is for you to do this.&nbsp; When working with clients, I see the tendency to move from one task to another, like an automaton, and without giving themselves the time to think, acknowledge wins or rest.<br><br>4)&nbsp;&nbsp; &nbsp;Keep a positive mental attitude. Not much more to say on this one, except that it will be easier to achieve if you apply points 1-3 and 5-8.<br><br>5)&nbsp;&nbsp; &nbsp;Don’t take it all too seriously!<br><br>6)&nbsp;&nbsp; &nbsp;When buying gifts, it’s not how much you spend, it’s how much thought goes&nbsp;&nbsp; into them and how you feel when you buy them that counts.&nbsp; If you’re feeling stressed and buy something expensive in a rush, then the receiver is receiving your stress.&nbsp; On the other hand, if you buy gifts when you’re feeling relaxed and happy, then the recipients will receive that energy. &nbsp;<br><br>Which do you think they will prefer?<br><br>7)&nbsp;&nbsp; &nbsp;When you notice the stress creeping in, stop, take a deep breath and feel grateful for everything and everyone in your life.&nbsp; This only takes a few minutes to do and yet the benefit can be proportionally much greater.<br><br>8)&nbsp;&nbsp; &nbsp;If you have lost loved ones, it’s normal to feel sad that they’re no longer with you. While that is perfect for your legal work, business is an altogether different kettle of fish.</p><p><br>I am certainly not suggesting that you throw caution to the wind.</p><p><br>However, remember that faint heart never won fair lady.</p><p><br>To put this into a business context, you must be willing to do something different if you want to have a thriving business.</p><p><br>Let’s just take one example where your firm and its lawyers might need to change.</p><p><br>💎 Be willing and able to turn down an unsuitable prospect. 💎</p><p><br>Really Vanessa, you must be joking, turn business away. Yes, yes and yes again.<br>What is an unsuitable client? I call them, rather irreverently, PITA clients which stands for Pain in The A and you can work out what the A stands for yourself.</p><p><br>They are the sort of clients who are:<br>🟣nit-picking<br>🟣always quibble about your fees<br>🟣want a discount<br>🟣don’t pay on time<br>🟣take up too much time and <br>🟣may not even be polite.</p><p>You know the ones, don’t you? <br><br>You’ve experienced them before and it’s not pleasant, is it?</p><p><br>What problems does this cause the firm?</p><p><br>💧It is losing money<br>💧Its lawyers are spending too much time on a job and therefore not billing on other jobs<br>💧Working with PITA clients depletes energy so your lawyers may be less productive which also impacts the bottom line.<br>💧Lawyers are more likely to be off sick.</p><p>I remember working with a seasoned employment lawyer who had been taught to hunt on the prairie.</p><p>&nbsp;<br>This means grab anything that comes along regardless of quality.</p><p><br>A big fat no!</p><p><br>What’s the solution?</p><p><br>🟣Decide as a firm to be discerning on who you take on as clients.<br>🟣In fact, what is your ideal client?<br>🟣Disseminate this to all staff, especially those who are client-facing.<br>🟣Even though you do this, it doesn’t mean that your lawyers will stop working with PITA clients, especially if it’s their habit, but it may reduce the number.</p><p>What they really need is training and coaching but that’s not your bag. Yet it’s not.</p><p>Why?&nbsp; For a few reasons:</p><p>🧿Because they are focused on the legal work and not on communicating clearly with the client.</p><p>🧿Because they lack confidence.</p><p>🧿Because they don’t know what to say.</p><p>🧿Because they under-estimate how long a job will take.&nbsp;</p><p>This means that they tell the client that the job will be completed on a certain date or at a certain time, but it is unrealistic.</p><p>Why do they do this?</p><p><strong>🟣</strong>Because it’s human nature to under-estimate and they don’t know that.</p><p><strong>🟣</strong> Because they are people-pleasers and want to keep the client happy, but it backfires on them.</p><p><strong>🟣</strong>Because it’s a habit that they keep on repeating.</p><p>Then what happens?</p><p>💧They miss the deadline and worse still,</p><p>💧they do not go back and tell the client!</p><p>Result:&nbsp; One not-so-happy client who then has ammunition to ask for money off the bill.</p><p>What’s the solution?</p><p>💥Ask the client how urgent the job is. Not much more to say on this one, except that it will be easier to achieve if you apply points 1-3 and 5-8.<br><br>5)&nbsp;&nbsp; &nbsp;Don’t take it all too seriously!<br><br>6)&nbsp;&nbsp; &nbsp;When buying gifts, it’s not how much you spend, it’s how much thought goes&nbsp;&nbsp; into them and how you feel when you buy them that counts.&nbsp; If you’re feeling stressed and buy something expensive in a rush, then the receiver is receiving your stress.&nbsp; On the other hand, if you buy gifts when you’re feeling relaxed and happy, then the recipients will receive that energy. &nbsp;<br><br>Which do you think they will prefer?<br><br>7)&nbsp;&nbsp; &nbsp;When you notice the stress creeping in, stop, take a deep breath and feel grateful for everything and everyone in your life.&nbsp; This only takes a few minutes to do and yet the benefit can be proportionally much greater.<br><br>8)&nbsp;&nbsp; &nbsp;If you have lost loved ones, it’s normal to feel sad that they’re no longer with you. Not much more to say on this one, except that it will be easier to achieve if you apply points 1-3 and 5-8.<br><br>5)&nbsp;&nbsp; &nbsp;Don’t take it all too seriously!<br><br>6)&nbsp;&nbsp; &nbsp;When buying gifts, it’s not how much you spend, it’s how much thought goes&nbsp;&nbsp; into them and how you feel when you buy them that counts.&nbsp; If you’re feeling stressed and buy something expensive in a rush, then the receiver is receiving your stress.&nbsp; On the other hand, if you buy gifts when you’re feeling relaxed and happy, then the recipients will receive that energy. &nbsp;<br><br>Which do you think they will prefer?<br><br>7)&nbsp;&nbsp; &nbsp;When you notice the stress creeping in, stop, take a deep breath and feel grateful for everything and everyone in your life.&nbsp; This only takes a few minutes to do and yet the benefit can be proportionally much greater.<br><br>8)&nbsp;&nbsp; &nbsp;If you have lost loved ones, it’s normal to feel sad that they’re no longer with you.
